29 CFR 1910.28(b)(1)(i): (1) Unprotected sides and edges. (i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: (A) Guardrail systems per 29 CFR 1910.28(b)(1)(i)(A); (B) Safety net systems per 29 CFR 1910.28(b)(1)(i)(B); or (C) Personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems per 29 CFR 1910.28(b)(1)(i)(C). Warehouse, Crown SP 3400 stockpicker: on or about July 16, 2018, employees were assigned to operate subject stockpicker with an unprotected long side of the operator's platform to pick products from inventory rack locations at heights over four feet above the adjacent ground level. Employees were exposed to fall hazards because adequate fall prevention and/or protection systems were not provided, and use of a body belt with retractable lanyard did not prevent and/or protect against falling. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.30(a)(3)(iv): The employer must train each employee in at least the following topics: (iv) The correct use of personal fall protection systems and equipment specified in paragraph (a)(1) of this section, including, but not limited to, proper hook-up, anchoring, and tie-off techniques, and methods of equipment inspection and storage, as specified by the manufacturer. Warehouse, Crown SP 3400 stockpicker: on or about July 16, 2018, the employer failed to train stockpicker operators in the correct use and inspection of a personal fall restrain system to prevent falls from the operator's platform. A body belt that was pierced for an additional belt hole was used with a retractable lanyard instead of a restricting short tether, and was connected to a jammed anchor point on the overhead rail that did not move freely along with the operator. Abatement documentation is required for this section in accordance with the requirements of 29 CFR 1903.19(d).

Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
