29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: guardrail systems, safety net systems, or personal fall protection system, such as a personal fall arrest, travel restraint, or positioning system: Employees engaged in grain handling activities were exposed to fall hazards of greater than approx. 30 feet from the distributor floor of the elevator to concrete below in that the employer did not use fall protection that meets the requirements of this standard.

29 CFR 1910.29(f)(4): Openings in a stair rail system exceeded 19 inches at its least dimension: Employees engaged in grain handling activities were exposed to fall hazards in that a complete stair rail system was not provided for stairways which created a opening greater than 19 inches: a) mid rail on one side of a stairway with four risers, approx. 72 inches above lower level; located between concrete bins b) mid rail on one side of a stairway with eleven risers, approx. 99 inches above lower level; located in the feed mill house leading to the basement c) mid rail on one side of a stairway with eight risers, approx. 72 inches above lower level; located near bin 21 inside the elevator
