29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program: Noise Monitoring was not conducted for employees with the following exposures: a) Diener / Chimer Area: A laborer was exposed to continuous noise levels in excess of the action level of 85 dBA as an 8 hour time weighted average. The employees dosimeter dBA level was 263.3% of the permissible level (90 dBA) and was equivalent to approximately 96.9 dBA. The sampling was performed for 442 minutes during one shift on 7/23/18. Zero exposure assumed for the unsampled period of time. b) Siphon Area/North end of facility: A laborer was exposed to continuous noise levels in excess of the action level of 85 dba as an 8 hour time weighted average. The employees dosimeter dBA level was 236.8% of the permissible level (90 dBA) and was equivalent to approximately 96.2 dBA. The sampling was performed for 432 minutes during one shift on 7/23/18. Zero exposure assumed for the unsampled period of time. c) Siphon Area/North end of facility: A laborer was exposed to continuous noise levels in excess of the action level of 85 dba as an 8 hour time weighted average. The employees dosimeter dBA level was 297.7% of the permissible level (90 dBA) and was equivalent to approximately 97.8 dBA. The sampling was performed for 431 minutes during one shift on 7/23/18. Zero exposure assumed for the unsampled period of time.

FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
