29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:    Noise Monitoring was not conducted for employees with the following exposures:    a) Diener / Chimer Area: A laborer was exposed to continuous noise levels in excess of the action level of 85 dBA as an 8 hour time weighted average. The employees dosimeter dBA level was 263.3% of the permissible level (90 dBA) and was equivalent to approximately 96.9 dBA. The sampling was performed for 442 minutes during one shift on 7/23/18. Zero exposure assumed for the unsampled period of time.      b) Siphon Area/North end of facility: A laborer was exposed to continuous noise levels in excess of the action level of 85 dba as an 8 hour time weighted average. The employees dosimeter dBA level was 236.8% of the permissible level (90 dBA) and was equivalent to approximately 96.2 dBA. The sampling was performed for 432 minutes during one shift on 7/23/18. Zero exposure assumed for the unsampled period of time.      c) Siphon Area/North end of facility: A laborer was exposed to continuous noise levels in excess of the action level of 85 dba as an 8 hour time weighted average. The employees dosimeter dBA level was 297.7% of the permissible level (90 dBA) and was equivalent to approximately 97.8 dBA. The sampling was performed for 431 minutes during one shift on 7/23/18. Zero exposure assumed for the unsampled period of time.

29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equaled or exceeded an 8-hour time-weighted average of 85 decibels:    Audiometric Testing was not conducted for the employees with the following exposures:    a) Diener/Chimer Area: A laborer was exposed to continuous noise levels in excess of the action level of 85 dBA as an 8 hour time weighted average. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
