29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section: a) 1289 Walker Road, Dover, DE - On or about June 22, 2018, the employer failed to ensure that the Stihl walk-behind saw used to cut a concrete foundation was operated while using the engineering controls specified in Table 1 of this standard. ABATEMENT NOTE: Table 1 found in 1926.1153 states that the following engineering controls must be used when a walk-behind saw is used to cut material containing silica: 1 - Use saw equipped with integrated water delivery system that continuously feeds water to the blade. Operate and maintain tool in accordance with manufacturer's instructions to minimize dust emissions.

An employee using a Stahl walk-behind to cut concrete without employing wet methods.

29 CFR 1926.1153(e)(1): Where respiratory protection was required by this section, the employer did not provide each employee an appropriate respirator that complied with the requirements of this paragraph and 29 CFR 1910.134: a) 1289 Walker Road, Dover, DE - On or about June 22, 2018, the employer failed to require the use of respiratory protection in accordance with 29 CFR 1910.134 for an employee who was exposed to respirable silica while operating a Stihl walk-behind saw to cut concrete. The saw was operated without the implementation of the Table 1 engineering controls. Abatement Note: Where respirator use is required by this section, the employer shall institute a respiratory protection program in accordance with 29 CFR 1910.134.
