29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  On or about July 19, 2018, in the shop area, employees were allowed to fabricate metal material while using unguarded machinery in the following instances:  A) Central Machinery 16 Speed Heavy Duty Floor Drill Press,  B) Central Machinery 12 Speed Production Drill Press,  C) Central Machinery 12 Speed 4 inch Spindle Stroke, and  D) DeWalt Chop Saw.

29 CFR 1910.217(c)(2)(i)(a): Point of operation guard(s) on mechanical power press(es) did not prevent entry of hands or fingers into the point of operation by reaching through, over, under or around the guard(s):  On or about July 19, 2018, in the shop area, employees were allowed to fabricate door frames with a Baileigh Tube Bender, which had its safety bypassed. The tube bender's foot pedal was held down by a weighted metal object, which caused the machine to run continuously, exposing employees to caught-in hazards.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  On or about July 19, 2018, at JCM Greenhouse, the employer failed to implement a written Hazard Communication Program to protect employees who were exposed to various chemicals in the workplace, including but not limited to, Dynaflux nozzle gel, Total Source High Performance touch up paint, and Cumberland lacquer thinner, which contains hazardous ingredients such as toluene, methanol, and acetone.
