29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.    Chavos Construction LLC located at 2709 Herons nest Place, Fort Collins, CO 80524: On and preceding 21 July 2018, the employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles to include but not limited to debris from use of pneumatic nail guns.  Employees installing wood trim pieces with a pneumatic nail gun on a residential roof were not utilizing eye or face protection.  This exposed the employees to struck by hazards.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    a) Chavos Construction LLC located at 2709 Herons nest Place, Fort Collins, CO 80524: On and preceding 21 July 2018, the employer who was operating a JLG Model 8042 rough terrain forklift was not trained to do so.  The owner was using the forklift to lift a 50" x 144" scaffold platform while a framer was working from the platform elevated more than 10 feet above ground level to install framing pieces. This exposed employees to struck-by and fall hazards.

29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person:    a) Chavos Construction LLC located at 2709 Herons nest Place, Fort Collins, CO 80524: On and preceding 21 July 2018, the employer did not ensure that a scaffold platform was designed by a qualified person.  An employee was unsafely elevated using a JLG Model 8042 rough terrain forklift to lift a 50" by 12 foot scaffolding platform to install framing pieces.    The platform extended more than 2 feet beyond the width of the wheel base on each side which created an unstable working surface on the far ends of the platform.  Due to the width of the platform and placement on the forks, the platform was not centered laterally which placed the platform approximately 20" beyond the end of the forks.  This exposed employees to fall and struck-by hazards.

An Employee was unsafely elevated using a JLG Model 8042 rough terrain forklift and a 50" by 12 foot platform to install framing pieces. The employer did not ensure that employees were protected from struck-by and fall hazards.

An employee was unsafely elevated using a JLG Model 8042 rough terrain forklift and a 50" by 12 foot platform to install framing pieces.  The front side of the platform was unprotected and the employee was not utilizing a personal fall arrest system. The employer did not ensure that employees were protected from struck-by and fall hazards.

An employee was working on the roof of a two-story house without the use of fall protection.  The condition exposed employees to fall hazards of up to of up to 20 feet.

A self supporting ladder that was folded together was used to access the upper level. The condition exposed employees to fall hazards.
