29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: a) Tortuga Construction located at 3032 Comet Street, Fort Collins, CO 80528: On and preceding 7/21/2018, the employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles. One employee was installing sheets of plywood on a residential roof using a pneumatic nail gun without the use of eye protection. This exposed the employees to struck-by injuries to the eyes.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): a) Tortuga Construction located at 3032 Comet Street, Fort Collins, CO 80528: On and preceding 7/21/2018, the employer did not ensure employees engaged in residential construction activities 6 feet or more above lower levels were protected by guardrail systems, safety net system, or personal fall arrest systems, nor were employees provided with an alternative means of fall protection. One employee was securing panels of plywood in place on a residential roof without the use of fall protection . The employee did not have a harness and anchors were not installed. This condition exposed the employee to falls from height.
