29 CFR 1926.1053(b)(15): Ladders shall be inspected by a competent person for visible defects on a periodic basis and after any occurrence that could affect their safe use.  a. On or about July 16, 2018, at a site located at 8675 York Road in Pataskala, Ohio, employees were exposed to fall hazards while using a Werner 24 foot fiberglass extension ladder, Model #D6224-2. The ladder had visible structural defects that included, but were not limited to, split side rails.  Employees that were preparing to install translucent roof panels used the ladder to access the roof of a new build, single story, water treatment plant that was approximately 15 feet tall. The employer did not ensure that the ladder was inspected prior to it being used at the site, or on a periodic basis.

29 CFR 1926.1060(a): The employer shall provide a training program for each employee using ladders and stairways, as necessary. The program shall enable each employee to recognize hazards related to ladders and stairways, and shall train each employee in the procedures to be followed to minimize these hazards.  a. On or about July 16, 2018, at a site located at 8675 York Road in Pataskala, Ohio, employees were installing translucent roof panels onto a new build, single story, water treatment plant that was approximately 15 feet tall. Employees used a Werner 24 foot fiberglass extension ladder, Model #D6224-2, to access the roof of the building.  The employer did not have a ladder training program in place and did not provide any instruction to employees regarding hazard recognition or use of the ladder.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.    a. On or about July 16, 2018, at a site located at 8675 York Road in Pataskala, Ohio, employees were installing translucent roof panels onto a new build, single story, water treatment plant that was approximately 15 feet tall. The employer never instructed the employees in the recognition and avoidance of unsafe conditions with the regulations applicable to protect employees from the hazards associated with performing roofing work or those associated with using portable ladders to access elevated work areas.
