29 CFR 1926.1053(b)(13):  The employer did not ensure that the top or top step of a stepladder was not used as a step:  The employer is failing to protect employees from the hazards associated with the improper use of a step ladder on a residential construction site.  The most recent occurrence of this was observed July 25th, 2018 at the existing residential home located at 19913 Birch St. Gretna, NE where the employer has an employee standing on the top rung of an aluminum Little Giant ladder in the A framed configuration as means of accessing the overhead gutters.

29 CFR 1926.1060(a)(1)(i):  The employer did not ensure that each employee using ladders and/or stairways had been trained by a competent person in the nature of fall hazards in the work area   The employer is failing to train employees on the recognition of hazards associated with and use of ladders as means of access/egress while performing residential construction activity.  The most recent occurrence of this was observed July 25th, 2018 at the existing residential home located at 19913 Birch St. Gretna, NE where the employer has an inadequately trained employee standing on the top rung of an aluminum Little Giant ladder in the A framed configuration as means of accessing the overhead gutters.
