OSH ACT of 1970 Section (5)(a)(1):   The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm, .employees operating the power industrial trucks did not wear seatbelts, exposing employees to the hazard of ejection or being crushed by or struck by the PIT.   At  worksite located at 14140 Botts Rd, Grandview, Missouri.-Employees were operating forklifts in the warehouse without wearing a seatbelt, including but not limited to a Hyundai brand power industrial truck, model # 30BC-9. 3000 KG load capacity.   Among other methods, feasible and acceptable means of hazard abatement include:  (1) wear seatbelt practices for safety and serviceability American National standard ANSI/ASC 2007 Standard for Specification for Dock One feasible and acceptable abatement method to correct this hazard is to follow ANSI/ITSDF B56.1-2007, which requires that all forklift operators wear the provided seatbelt.   Chapter 5 OPERATING SAFETY RULES AND PRACTICES   Section 5.3 Traveling  5.3.18   The operation of a counterbalanced, center control, high lift truck with a sit-down, non elevating operator requires special safety considerations, as follows: (d) The operator should stay with the truck if lateral or longitudinal tipover occurs. The operator should hold on firmly and lean away from the point of impact.    5.3.19 An active operator protection device or system, when provided, shall be used. Operator protection in the  event of tipover is intended to reduce the risk of  entrapment of the head and torso between the truck and  the ground but may not protect the operator against all  possible injury However, steps  indicated in paras. 5.3.18(d) a should still be  adhered to.
