Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) #2 J-2 Estate Paradise, Building 6: Employees working as laborers installing 2x4 bracing for roof trusses on the second floor were exposed to fall hazards when the employer failed to ensure the use of guardrails, safety net systems, or personal fall arrest systems at the unprotected edge of the stairway landings, 9.5 feet above the level below, on or about 7/19/2018.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge: a) #2 J-2 Estate Paradise, Building 6: Employees working as laborers installing 2x4 bracing for roof trusses on the second floor utilized the two poured concrete stairways, each having 17 risers, to access the second floor. The employer failed to ensure that the stairways were equipped with a stairrail system along the unprotected sides, on or about 7/19/2018. Note: 29 CFR 1926.1052(c)(7) applies when the top edge of a stairrail system also serves as a handrail.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: a) #2 J-2 Estate Paradise, Building 6: Employees working as laborers use a 13 foot tall tubular welded frame scaffold to access the exterior edge of the roof while installing 2x10 fascia along the edge of the roof eaves. The employer did not ensure the use of fall protection, exposing the employees to fall hazards, on or about 7/18/2018.
