29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels: a) Mixing area: On or about August 1, 2018, and at times prior, the employer exposed the mixer to noise levels above the action level of 87 decibels (66% dose) without providing an audiometric test. The employee had an exposure of 87.5 decibels (71.06 % dose) during the 295 minute sampling period. The exposure calculation included a zero increment for the 185 minutes not sampled. b) Mixing area: On or about August 1, 2018, and at times prior, the employer exposed the mixer to noise levels above the action level of 87 decibels (66% dose) without providing an audiometric test. The employee had an exposure of 95.6 decibels (218.1 % dose) during the 288 minute sampling period. The exposure calculation included a zero increment for the 192 minutes not sampled. c) Mixing area: On or about August 1, 2018, and at times prior, the employer exposed the mixer to noise levels above the action level of 87 decibels (66% dose) without providing an audiometric test. The employee had an exposure of 87.5 decibels (70.60 % dose) during the 292 minute sampling period. The exposure calculation included a zero increment for the 188 minutes not sampled.
