29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: a) On July 27, 2018 at a commercial construction site located at 101 S. IH45, Hutchins, TX an employee was observed using a JLG model 600S boom lift to access steel cross members without personal fall restraint or arrest sytem exposing that employee to a fall hazard of approximately twenty-one (21) feet to the ground below. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).

29 CFR 1926.454(a)(1): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with scissor lifts regarding the nature of any electrical hazards, fall hazards and falling object hazards in the work area: a) On July 27, 2018 at a commercial construction site located at 101 S. IH45, Hutchins, TX an employee was observed standing on the middle rail while using a JLG model 3369LE scissor lift to access steel cross members exposing that employee to a fall hazard of approximately eighteen (18) feet to the concrete floor below. b) On July 27, 2018 at a commercial construction site located at 101 S. IH45, Hutchins, TX an employee was observed standing on the middle rail while using a Skyjack model SJIII-3219 scissor lift to access steel cross members exposing that employee to a fall hazard of approximately eighteen (18) feet to the concrete floor below.
