29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.   a) On or about July 24, 2018,  the employer failed to ensure that employees conducting roofing activities on the flat roof of the building locate at 1260 Palm Coast Pkwy SW in Palm Coast Florida, working and walking exposed to a fall of more than six (6) feet to the ground, were protected from falling by the use of a guardrail system, safety nest system or personal fall arrest system.  The employer opted to use warning lines, but the employees in the working area were not protected by an effective fall arrest system nor by implementing a monitor system.

29 CFR 1926.502(f)(1)(i): When no mechanical equipment was being used the warning line was not erected at least 6 feet (1.8m) from the roof edge:  a) On or about July 24, 2018,  the employer failed to ensure that the warning line system used to warn employees conducting roofing activities on the flat roof of the building locate at 1260 Palm Coast Pkwy SW in Palm Coast Florida, working and walking exposed to a fall of more than six (6) feet to the ground were placed less than six (6) feet from the edge, to warn employees of the location of the edge and to protect them from falling.

29 CFR 1926.502(f)(1)(iii): Points of access, material handling areas, storage areas, and/or hoisting areas were not connected to the work area by an access path formed by two warning lines:  a) On or about July 24, 2018,  the employer failed to ensure that on the flat roof of the building locate at 1260 Palm Coast Pkwy SW in Palm Coast Florida where the employees were conducting roofing activities the point of access used for disposing of materials was connected to the work area by a path formed by two warning lines. Employees disposing materials by tossing the materials over the warning lines from the working area were exposed to a fall of more than six (6) feet.

29 CFR 1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  a) On or about July 24, 2018,  the employer failed to certified that the employees conducting roofing activities on the flat roof of the building locate at 1260 Palm Coast Pkwy SW in Palm Coast Florida, working and walking exposed to a fall of more than six (6) feet to the ground, were properly trained by a competent person as necessary on fall protection to be able to recognize nature of the fall hazards in the work area and in the procedures to be followed to minimize these hazards.

29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye.  a) On or about July 24, 2018,  the employer failed report to OSHA an accident resulting in a in-patient hospitalization within 24 hours. On July 26, 2018 the employer reported an employee's fall resulting in injuries requiring hospitalization that occurred on July 24, 2018.The employer had the option to report the employee hospitalization on-line at osha.gov or by calling the OSHA 24-hour hotline or the Jacksonville Area Office.

29 CFR 1926.59:  An employer engaged in construction activities did not comply with the requirements set forth in Part 1910, Section 1200, Hazard Communication:  a) On or about July 31, 2018,  in the jobsite located at 1260 Palm Coast Pkwy SW in Palm Coast Florida, the employer failed developed and implement a Hazard Communication Program for the protection of employees using hazardous chemicals including but not limited to Gasoline and Firestone's "Splice-Wash SW-100" cleaner.
