29 CFR 1926.760(a)(1): Except as provided by paragraph (a)(3) of this section, each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level shall be protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems. On August 14, 2018, located on the northeast side of a commercial steel roof structure, employees were exposed to a fall hazard while standing on a roof purlin setting metal roof panels being lowered by a crane not utilizing an adequate fall protection system. Potential fall height was measured to be 22'-9".

29 CFR 1926.761(b): Fall hazard training. The employer shall train each employee exposed to a fall hazard in accordance with the requirements of this section. The employer shall institute a training program and ensure employee participation in the program. On August 14, 2018, located on the northeast side of a commercial steel roof structure, employees were exposed to a fall hazard while standing on a roof purlin setting metal roof panels while not utilizing any fall protection system and had not been trained by the employer to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards. Employees were exposed to a potential fall height of greater than 22 feet above the ground below. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
