29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:    (a) Cemcast Pipe and Precast, LLC at 26088 466th Avenue, Harford, SD 57033: On or about and at times prior to August 16, 2018, the employer did not ensure employees were exposed to hazards associated with respirator use in that the employer did not provide a medical evaluation to employees prior to the employee being required to used a respirator when performing work. This exposed employees to hazards associated with respirator use.

29 CFR 1910.134(f)(1): The employer did not ensure that employee(s) required to use a tight-fitting face piece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT):    (a) Cemcast Pipe and Precast, LLC at 26088 466th Avenue, Harford, SD 57033: On or about and at times prior to August 16, 2018, the employer did not ensure employees were protected from chemical hazards in that the company did not ensure employees passed a fit test prior to being required to wear a respirator to perform work. This exposed employees to chemical hazards.

29 CFR 1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function:    (a) Cemcast Pipe and Precast, LLC at 26088 466th Avenue, Harford, SD 57033: On or about and at times prior to August 16, 2018, the employer did not ensure employees were protected from chemical hazards in that the employees were allowed to use tight fitting respirators with visible facial hair growth that would prevent a seal between the face piece and the face. This condition exposed employees to chemical hazards.

29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a forklift:    (a) Cemcast Pipe and Precast, LLC at 26088 466th Avenue, Harford, SD 57033: On or about and at times prior to August 16, 2018, the employer did not ensure employees were protected from hazards associated with the operation of a forklift in that the employer did not ensure each employee operating forklifts for production purposes had successfully completed training required by paragraph (l). This condition exposed employees to hazards associated with forklift operation.
