29 CFR 1910.134(c)(1): In any workplace where respirators were necessary to protect the health of the employee or whenever respirators were required by the employer, the employer did not establish and implement a written respiratory protection program with worksite-specific procedures. A program was not updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer did not include in the program the provisions of this section, as applicable:    a) 195 Raritan Center Parkway, Edison, NJ 08837 - Polishing and Anodizing departments    The employer did not have a written respiratory protection program for employees required to use N95 dust masks to perform work duties.    Violation occurred on or about 6/21/2018.    WRITTEN ABATEMENT CERTIFICATION IS REQUIRED PURSUANT TO 29 CFR 1903.19.

29 CFR 1910.134(k)(3): The employer did not provide the training prior to requiring the employee to use a respirator in the workplace:  a) 195 Raritan Center Parkway, Edison, NJ 08837 - Polishing and Anodizing departments  The employer did not ensure that all employees required to wear N95 dust masks while performing work duties were provided with respiratory protection training to include elements covered in a written respiratory protection program such as but not limited to proper use, medical limitations and maintenance of such respirators before employees began to use them while performing work duties. They were not provided with adequate training such the location and availability of a written hazard communication program or how the criteria for labeling, accessing appropriate safety data sheets and receiving employee training should be met.
