29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5). (a). On or about August 22, 2018, the employer did not ensure each operator was trained on the safe operation of the JLG Sky Trak, model 6042, rough terrain forklift prior to being permitted to operate it.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. (a) On or about August 22, 2018, Employees were setting trusses for a flat roof of a commercial building without fall protection. Thereby exposing employees to an approximate 15 foot fall hazard.

OSH ACT of 1970 Section (5)(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard while conducting concrete activities from the elevated forks of a Mustang 2054 Skid Steer Loader. (a) On or about August 22, 2018, at a jobsite located at 4770 S. Moorland Rd New Berlin, Wisconsin, employees accessed their working area by riding forks of a JLG Sky Track rough terrain forklift while being exposed to an approximate 15 foot fall hazard.
