29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c) of this section:    (a) On or about August 24, 2018, the employer did not ensure that employees conducting work in a trench were fully protected from cave-in hazards, in that work performed to install a new sewer line was done in the northern area of the trench that had an unprotected wall approximately 8 feet in height.    Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:  (a) On or about August 24, 2018, the employer did not ensure that an effective inspection of the excavation, the adjacent areas, and the protective systems was conducted by a competent person as needed throughout the shift, in that during new sewer line installation protective systems were utilized.  Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
