29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    (a) Honey Smoked Fish Holdings, LLC at 21151 E. 31st Circle, Aurora , CO: On and before August 29, 2018, the employer did not ensure all forklift operators were trained in the operation of powered industrial trucks in that the employer relied upon the powered industrial truck training of the forklift operator's prior employer without ensuring that the training was appropriate for the truck and work conditions encountered at the establishment and in that the forklift operator was not trained in the use of the Unicarriers Electric Walkie Pallet Jack and Crowne RC 3000 Series Forklift prior to their use and work conditions encountered at the establishment. This condition potentially exposed employees to struck-by and caught-between hazards of forklift operation.    Abatement Note:  Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:    (a) Honey Smoked Fish Holdings, LLC at 21151 E. 31st Circle, Aurora , CO: On and before August 29, 2018, the employer did not ensure that all employees were provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment. For employees who did receive training, it did not include physical and health hazards of chemicals in the work area. Employees were potentially exposed in Rinsing, Smoking, Production and Shipping and Receiving areas to hazardous chemicals, including but not limited to Sani-T-10 Plus, Foaming Caustic Cleaner FP, Chlorinated Degreaser, and/or carbon monoxide. This condition potentially exposed employees to chemical hazards.    Abatement Note: Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.

The employer did not provide any methods, such as continuous carbon monoxide air monitoring, to ensure that employees could detect exposure to carbon monoxide due to unexpected releases or increases in carbon monoxide concentrations, such as a loss of mechanical integrity at smoker cabinets or the loss of ventilation in the smoker room. This condition could potentially result in employees being exposed to respiratory hazards.

29 CFR 1910.38(b): An emergency action plan was not in writing, kept in the workplace, and available to employees for review:  (a) Honey Smoked Fish Holdings, LLC at 21151 E. 31st Circle, Aurora , CO: On and before August 29, 2018, the employer did not ensure that an emergency action plan was developed and available to employees for review at the site. The employer had developed Crisis Management Program and Fire Safety Training documents, which met some of the elements of an emergency action plan, but did not designate smoker room employees to fight incipient stage fires with portable fire extinguishers rather than evacuate the building.   Abatement Note: An emergency action plan must include at a minimum: procedures for reporting a fire or other emergency; procedures for emergency evacuation, including type of evacuation and exit route assignments; procedures to be followed by employees who remain to operate critical plant operations before they evacuate; procedures to account for all employees after evacuation; the name or job title of every employee who may be contacted by employees who need more information about the plan or an explanation of their duties under the plan.

29 CFR 1910.305(a)(2)(xi): Support for cable assemblies and flexible cords and cables were not installed so as not to cause damage:  (a) Honey Smoked Fish Holdings, LLC at 21151 E. 31st Circle, Aurora , CO: On and before August 29, 2018, the employer did not ensure that support for cable assemblies and flexible cords and cables were installed so as not to cause damage. The flexible extension power cord, supplying power to portable fans in the smoker room, was damaged in proximity to the plug. The damaged cord was attached to the exterior of the swing doors leading into the smoker room, where employees could potentially make physical contact with the damaged plug, while entering the smoke room through the swing doors. The conductors of the live circuit were insulated and not exposed.  Effective support had not been provided to the flexible power cord to prevent damage. This condition exposed employees to an electrical hazard.
