29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).    a) The employer did not train or evaluate each operator prior to allowing employees to operate powered industrial vehicles such as but not limited too; box truck and Caterpillar forklifts.

Powered industrial truck operators shall receive initial training in the following topics, except in topics which the employer can demonstrate are not applicable to safe operation of the truck in the employer's workplace.    a) On or about 9/4/2018 an employer did not have a power industrial truck training program to ensure operators received initial training in order to verify safe operations such as but not limited to; allowing employees to ride in the back of the open box truck in the yard.

29 CFR 1910.178(l)(4)(i): Refresher training, including an evaluation of the effectiveness of that training, shall be conducted as required by paragraph (l)(4)(ii) to ensure that the operator has the knowledge and skills needed to operate the powered industrial truck safely.    a) On or about 9/4/2018 an employer did not perform an evaluation of each power industrial truck operator's performance to ensure that each operator had the knowledge and skills needed to operate the powered industrial truck safely.
