After that time, that data was not made available to the Secretary when requested:  a) On or about September 5, 2018, the employer failed to maintain at the jobsite a copy of the tabulated data during the construction of the protective system to be used in a trench that was measured to be approximately seven feet in depth.   b) On or about September 6, 2018, the employer did not ensure the tabulated data for the protective system to be used in a trench that was measured to be approximately seven feet in depth was made available to the Secretary upon request.
