29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): (a) Roof - Employees did roofing work, including unloading shingles, installing metal flashing, and installing felt paper, on the two-story single-family home. The employees did not use guardrail systems, safety net systems, or personal fall arrest systems for fall protection. Instead, employees wore climbing harnesses and had ropes with rope clamp ascension devices available for connecting the climbing harnesses to the ropes, but the employees did not connect to the ropes at all times, and the roof had only three ropes for five employees, exposing the employees to the hazard of falling from the roof to the ground below, on or about September 4, 2018. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: (a) Roof - To gain access to the roof, employees used a portable extension ladder, positioned at the driveway and leaning against the part of the home facing Bernays Drive. This ladder only extended two feet above the roof (upper landing) surface, exposing the employees to the hazard of falling about 10 feet to the ground below, on or about September 4, 2018. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
