29 CFR 1926.303(b)(1): Grinding machines were not equipped with safety guards in conformance with the requirements of ANSI B7.1-1970, Safety Code for the Use, Care, and Protection of abrasive wheels, and paragraph (d) of this section:    a) Worksite - On or about August 24, 2018, employees were exposed to struck-by hazards due to an employee using a Dewalt model DWE4011, type 1, 4 1/2" angle grinder without a guard to grind down a foot print left in the concrete. The wheel that was used on this grinder was a Carborundum SC15M Type 11 flaring cup wheel.

29 CFR 1926.303(c)(3): Cup type abrasive wheels used for external grinding were not protected by either a revolving cup guard or a band type guard:    a) Worksite - On or about August 24, 2018, employees were exposed to struck-by hazards due to an employee using a Dewalt model DWE4011, type 1, 4 1/2" angle grinder without a guard to grind down a foot print left in the concrete.  The wheel that was used on this grinder was a Carborundum SC15M Type 11 flaring cup wheel.

29 CFR 1926.303(c)(7): All abrasive wheels were not closely inspected and ring-tested before mounting to ensure that they are free from cracks or defects:    a) Worksite - On or about August 24, 2018, employees were exposed to struck-by hazards due to an employee using a Dewalt model DWE4011, type 1, 4 1/2" angle grinder without closely inspecting and ring-testing a Carborundum SC15M Type 11 flaring cup wheel mounted on the grinder to ensure that the wheel was free from cracks or defects.

29 CFR 1926.303(d): All abrasive wheels and tools used by employees did not meet other applicable requirements of American National Standards Institute, B7.1-1970, Safety Code for the Use, Care and Protection of Abrasive Wheels:    a) Worksite - On or about August 24, 2018, employees were exposed to struck-by hazards due to, but not limited to, an employee operating a Dewalt model DWE4011, type 1, 4 1/2" angle grinder rated for 12,000 RPM's with a Carborundum SC15M Type 11 flaring cup wheel rated for a maximum of 6045 RPM's exceeding the speed rating of the wheel.  Also, the Carborundum SC15M Type 11 flaring cup wheel is not an appropriate accessory to be used on the Dewalt model DWE4011, type 1, 4 1/2" angle grinder as stated in the tool's instruction manual.
