Citation 1, Item, 2b: 29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):    Location: 6 West Shore Road, Merrimac, MA    On or about September 5, 2018, the workplace was not assessed and certified of hazards through a written hazard assessment for but not limited to employees operating a Husqvarna, model #460 Rancher chainsaw and did not require the use of leg chaps and a face shield.

On or about June 12, 2019, abatement documentation was not submitted for the following citations issued on December 18, 2018;    1. Citation 1, Item, 1: OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to cut and laceration hazards.    Location: 6 West Shore Road, Merrimac, MA    On or about September 5, 2018, employees were exposed to laceration hazards while an employee operated a large Husqvarna, model #460 Rancher chainsaw with one hand from a 24-foot Werner extension ladder.    2. Citation 1, Item 3: 29 CFR 1910.333(c)(3)(i)(A)(1): When an unqualified person was working in an elevated position near overhead lines with voltages to ground rated at 50 kV or below, the location was not such that the person and the longest conductive object he or she could contact came closer than 10 ft. (305 cm) to any unguarded, energized overhead line:    Location: 6 West Shore Road, Merrimac, MA    On or about September 5, 2018, an employee working from a 24-foot Werner portable extension ladder at a height of approximately 20-feet, 10-inches held the energized overhead electrical line attached to the house with the left hand, while utilizing the chainsaw with the right hand to cut a limb off the tree.
