29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: Worksite located at 72 Kiln Drive, St. Elizabeth, Missouri- On or about August 28, 2018, an employee fell from an unprotected edge of the 2nd level of the home structure and broke his femur. The employee was not protected from falling by the use of a guardrail system, safety net system, or personal fall arrest system.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: Worksite located at 72 Kiln Drive, St. Elizabeth, Missouri- Employees working near unprotected edges had not been trained on the recognition and avoidance of fall hazards and the means necessary to mitigate the fall hazards.

The employee was treated and admitted to a hospital for his injuries. The employer failed to report the incident to OSHA within a required 24 hour period from time of incident.
