29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). a) Warehouse - On or about 9/7/2018, the employer exposed employees to struck-by hazards, in that the employer failed to ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely by providing training and evaluation of operation to the forklift operators.

29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily: a) Warehouse - On or about 9/7/2018, the employer exposed employees to struck-by hazards, in that employer failed to ensure that Crown forklift truck was examined before being placed in service and daily before each shift.
