29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. On September 10, 2018, employees were attempting to remove concrete blockage on a Concord Concrete Pump Truck Model# CCP-50XZ-170 as a competent person did not conduct frequent and regular inspections to ensure lockout/tagout procedures on the Concord Concrete Pump was being followed for the safe application, usage, and removal of energy sources such as the air that controls the pump. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. On September 10, 2018, located on the 2nd floor decking of an exterior commercial structure, employees attempting to remove concrete blockage on a Concord Concrete Pump Truck Model# CCP-50XZ-170 had not been trained by the employer on lockout/tagout procedures to recognize the release of potentially hazardous energy such as air stored inside the line and the procedures to be followed in order to control or eliminate the hazard. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.702(j)(1): No employee shall be permitted to perform maintenance or repair activity on equipment (such as compressors mixers, screens or pumps used for concrete and masonry construction activities) where the inadvertent operation of the equipment could occur and cause injury, unless all potentially hazardous energy sources have been locked out and tagged. On September 10, 2018, an employee was struck by the boom and was thrown off the 2nd floor decking prior to attempting the removal of a concrete blockage that was under pressure located on or near the reducer of a Concord Concrete Pump Truck Model# CCP-50XZ-170 in that the air had not been locked out or tagged out. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
