29 CFR 1926.451(c)(3): Supported scaffold poles, legs, posts, frames, and uprights were not plumb and braced to prevent swaying and displacement: a) Building C - On or about July 18, 2018 and prior to, employees working on a three tier tubular welded frame scaffold were exposed to struck-by hazards and fall hazards of up to approximately 17 feet, 8 inches in that the employer did not ensure that all of the frames were plumb to prevent swaying and displacement including: The yellow scaffold frame on the far right end (when facing the building) of the 3rd level; The red scaffold frame on the far left end (when facing the building) of the 2nd level; and The red scaffold corner frame on the far left end (when facing the building) of the 2nd level.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used: a) Building C - On or about July 18, 2018 and times prior to, employees working on the second level of a three tier tubular welded frame scaffold accessed scaffold platforms that were more than 2 feet above a point of access by climbing the ends of the scaffold, which were not equipped with suitable means of access, thus exposing employees to fall hazards of up to approximately 17 feet, 8 inches.
