29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure: a) Guardian Metal Systems, LLC, 138 Elk Place, Black Hawk, CO 80422: On and before September 19, 2018, each employee engaged in the construction of a new roof on a residential garage was not protected by guardrail systems, safety net system, or personal fall arrest system. A employee was installing the snow and ice shield underlayment when he fell approximately 11.5 feet from the gable end of the roof. This condition exposed employees to fall hazards of up to approximately 15 feet.

29 CFR 1926.503(a)(2): The employer did not assure that each employee had been trained, as necessary, by a competent person qualified in the following areas: (i) The nature of fall hazards in the work area; (ii) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; (iii) The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used; a) Guardian Metal Systems, LLC, 138 Elk Place, Black Hawk, CO 80422: On and before September 19, 2018 the employer did not assure that each employee had been trained, as necessary, by a competent person qualified when multiple employees were using the same fall protection anchor and removing fall protection while on the roof. A employee was applying underlay material on a roof when he fell from height.
