29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    a)  Sewer Solutions located at 1374 Yates Street, Denver, CO 80204:  On and Preceding September 20th, 2018, the employer did not ensure that employees were trained in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards.  Workers were digging and performing work in a trench which was up to approximately 12 feet deep using a Bobcat mini excavator to tie in to a main sewer line for a new construction multi-family dwelling. Workers engaged in trenching and plumbing operations were not trained by the employer in areas of safety which include but are not limited to trenching safety and earth moving equipment operations.  The following condition exposed employees to struck-by hazards.

Workers were digging and working in a trench which was up to approximately 12 feet deep to tie in to a main sewer line for a new construction multi-family dwelling. The following condition exposed employees to struck-by and caught-in/between hazards.    Sewer Solutions, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent 29 CFR 1926.652(a)(1) which was contained in OSHA inspection number 1014978, citation number 1, Item 1, issued February 20, 2015 and became a final order on March 17, 2015, with respect to a workplace located at 1470 Lehigh Street, Boulder, CO 80305.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:       a)  Sewer Solutions located at 1374 Yates Street, Denver, CO 80204:  On and Preceding September 20th, 2018, the employer did not ensure a written hazard communication program which at least described how the criteria specified for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also included a hazardous chemicals list and methods used to inform employees of the hazards of non-routine tasks, had not been developed for employee exposures, such as but not limited, to the following:      (1) The employees used gasoline and epoxy resin material used in the Perma Liner inversion machine to line sewer pipe.  These materials can expose employees to skin and respiratory hazards.    Sewer Solutions, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent 29 CFR 1910.1200(e)(1) which was contained in OSHA inspection number 1014978, citation number 1, Item 2/a, issued February 20, 2015 and became a final order on March 17, 2015, with respect to a workplace located at 1470 Lehigh Street, Boulder, CO 80305.

Workers were digging and working in a trench which was up to approximately 12 feet deep to tie in to a main sewer line for a new construction multi-family dwelling. A trench collapse resulted in employee injuries requiring in patient hospitalization on 9/20/2018 at approximately 1:15 PM.  The employer did not report the hospitalization until 24 September, 2018 at 2:54 PM.
