29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel:    a) On or about October 29, 2018 and times prior; A forklift in unsafe operating condition not taken out of service: The Employer failed to ensure an unsafe orange Nissan forklift (serial number KUGH02A30V) was taken out of service due to items such as a missing rubber pad for gas pedal, a backup alarm which did not work, and a worn tire which exposed the operator/employees to the hazards associated with an operator loosing control or backing up without warning.      b) On or about October 26, 2018 and times prior; A forklift in unsafe operating condition not taken out of service: The Employer failed to ensure an unsafe orange Nissan forklift (serial number KUGH02A30V) was taken out of service due to items such as a missing rubber pad for gas pedal, a backup alarm which did not work, and a worn tire which exposed the operator/employees to the hazards associated with an operator loosing control or backing up without warning.
