29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (a) The employer did not develop, fully implement, and maintain a written hazard communication program at the workplace where employees were exposed to hazardous chemicals, including gasoline and mortar (containing Portland cement).   (b) A mortar mixer and at least one mason had not been provided with information and training (stipulated in 1910.1200(h)(2) and (h)(3)) on hazardous chemicals in their work area or been trained on the new chemical container label elements and the new format and types of information on each section of the Safety Data Sheet, with respect to revisions to the standard in accordance with the Globally Harmonized System of Classification and Labeling of Chemicals (GHS).  ABATEMENT CERTIFICATION IS REQUIRED

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:  (Construction Reference 1926.103)  (a) A mortar mixer who voluntarily wore an N95 disposable filtering facepiece respirators while mixing mortar was not provided with the basic advisory information on respirators contained in Appendix D of the respirator standard.  ABATEMENT CERTIFICATION IS REQUIRED

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided:  (a) A mortar mixer was using inappropriate leather gloves while mixing and shoveling mortar at a gasoline powered mortar mixer.   (b) Brick masons were not provided with protective gloves while handling wet mortar.     ABATEMENT CERTIFICATION IS REQUIRED
