A written plan for controlling employee exposure to respirable crystalline silica was not established and implemented by the employer.  Conditions were noted on or about on 10/05/2018.

29 CFR 1926.1153(c)(1): Specified exposure control methods. For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  a) Y Construction & Maintenance RC LLC., Avenel, NJ  -Employees used hand-held power saws and grinders for cutting and smoothing concrete slab seams on the outer walls of a newly-constructed home. The prescribed engineering controls listed in Table 1 for these specific tasks were not implemented, exposing workers to inhalation health hazards of crystalline silica.  Conditions were noted on or about  on 10/05/2018.
