29 CFR 1910.95(c)(1): The employer shall administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent.     On or about October 15, 2018 employees were exposed to noise levels of 85 decibels or greater. The employer did not implement an effective hearing conservation program for affected employees.    (a)   A Labor using tools such as, but not limited to, saws and hammers was exposed to an 8-hour TWA noise level of 89.1 with a dose 88.6 percent. (b)   A Labor using tools such as, but not limited to, saws and hammers was exposed to an 8-hour TWA noise level of 88.6 with a dose of 83.3 percent. (c)  A Labor using tools such as, but not limited to, saws and hammers was exposed to an 8-hour TWA noise level of 89.8 with a dose of 97.8 percent.       No abatement certification or documentation is required for this item
