29 CFR 1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail and one stairrail system along each unprotected side or edge: (a) New residential construction located at 12535 Rumson Court, Alpharetta, GA 30009, Temporary stairway: On or about 10/12/2018, and at times prior, the employer exposed employees to falls up to 10-feet, 10-inches to the lower level, in that stair rails were not provided along the open sides of the temporary stairway installed to access the second floor.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) New residential construction located at 12535 Rumson Court, Alpharetta, GA 30009, Upper roof: On or about 10/12/2018, and at times prior, the employer exposed employees to fall hazards of 29-feet, 8-inches to the lower level, in that no fall protection was provided to employees installing plywood sheathing on a 10/12 pitched roof without a fall protection system in place. (b) New residential construction located at 12535 Rumson Court, Alpharetta, GA 30009, Lower roof: On or about 10/12/2018, and at times prior, the employer exposed employees to fall hazards of 14-feet, 9-inches to the lower level, in that no fall protection was provided to an employee using a 5/12 pitched roof as a walking/working surface to remove debris from the second level. c) New residential construction located at 12535 Rumson Court, Alpharetta, GA 30009, Second floor: On or about 10/12/2018, and at times prior, the employer exposed employees to fall hazards of 10-feet, 10-inches to the lower level, in that fall protection was not provided along all open edges and openings of the second floor walking/working surface.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles. (a) New residential construction located at 12535 Rumson Court, Alpharetta, GA 30009, Second floor: On or about 10/12/2018, and at times prior, the employer exposed employees to struck-by hazards while operating pneumatic framing nail guns, in that protective eyewear was not provided to employees engaged in framing and sheathing activities while operating these tools at 120 PSI. Julian Maldonado Vazquez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1237783, citation number 1, item number 1 and was affirmed as a final order on 08/29/2017, with respect to a workplace located at 4446 Briarcliff Drive NE, Atlanta, GA 30345.
