29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) Residential Building, 6 East Chestnut Street, Wilkes-Barre, PA - An employee on the 12:12 pitch portion of the main roof was engaged in roof replacement activities without any means of fall protection and was exposed to a thirty (30) foot fall hazard, as observed on or about October 22, 2018. In accordance with 29 CFR 1903.19, abatement certification is required for this violation.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed. a) Residential Building, 6 East Chestnut Street, Wilkes-Barre, PA - Employees used a 40-foot Type I Werner Aluminum D-Rung Extension Ladder - Model D1340-2 or a 40-foot Type 1 Louisville Aluminum Extension Ladder - Model AE3240 for roof access/egress with fly section side rails that each extended fourteen (14) inches above the roof edge exposing the employees to a fall hazard, as observed on or about October 22, 2018. In accordance with 29 CFR 1903.19, abatement certification is not required for this violation as the hazardous condition was corrected during the inspection.
