29 CFR 1926.451(e)(1): A means of access for scaffold platforms more than 2 feet (0.6 m) above or below a point of access, such as portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used. a) Jobsite - The employer did not provide a safe means of access from one level of the supported tubular welded frame scaffold to another by the use of portable ladders, hook-on ladders or other acceptable means. Employees used the rungs on the scaffold Integral Prefabricated Access Frames, which were approximately 5" in width, not uniform in spacing, or horizontal in design, to access the 2nd walking/working level of the scaffold. Observed on or about 10/29/18.

29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee was not protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. a) Jobsite: Employees conducting masonry operations from the 2nd walking/working platform of the supported tubular welded frame scaffold, and from the outrigger section above the 2nd walking/working platform, were exposed to fall hazards of approximately 14' - 18' above ground level without the use of a fall protection system. Observed on or about 10/29/18.
