29 CFR 1910.146(d)(3)(vi): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not develop and implement the means, procedures, and practices to verify that conditions in a permit space were acceptable for entry throughout the duration of an authorized entry:    (a) On or about October 31, 2018, and times prior, at the workplace located at 700 E. Jones St., Milwaukee, WI 53207, D&D Building #258, 2nd floor, the employer did not verify conditions inside of Dryer #5 were safe and acceptable for entry and throughout the duration of the blade replacement process to protect employees from the unexpected energization, startup, or release of stored energy.

29 CFR 1910.147(f)(3)(i): A procedure was not utilized to afford the employees a level of protection equivalent to that provided by the implementation of a personal lockout or tagout device when servicing and/or maintenance was performed by a crew, craft:  (a)  On or about October 31, 2018, and times prior, at the workplace located at 700 E. Jones St., Milwaukee, WI 53207, D&D Building #258, 2nd floor, the employer did not ensure a procedure was utilized that afforded employees a level of protection equivalent to that of a personal lockout or tagout device being applied when performing blade replacement activities on Dryer#5.
