OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.  On or about October 20, 2018 and times prior the Ford/New Holland Model 555D, Serial number A428823 Backhoe was being used with a Company manufactured scaffold attached to the forks which had not been approved by the manufacture for the specific machine.  Employees were exposed to falls while working from the scaffold platform installing new LED lights and photo-eye sensors of approximately 7-9 feet to the asphalt surface.

Employers must ensure employees are trained in the requirements of this paragraph on or before May 17, 2017.  a) On or about October 20, 2018 and times prior at 19800 Oak Rd. West, Gulf Shores, Al: The employer failed to ensure employees exposed to fall hazards while changing light bulbs and installing photo-eye sensors were trained on the use of personnel fall arrest systems.  Employees wrapped their lanyard around the top rail of a manufacture scaffold system attached to a backhoe and connected the snap hook back to the lanyard which is not permitted.
