OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees; in that, employees were exposed to being crushed-by palletized loads and steel storage racks.     On or about October 22, 2018, at 2211 Vista Parkway, Suite #8, West Palm Beach Florida, the employer failed to protect workers who were exposed to crush-by hazards from steel storage racks which were lacking plaques to indicate maximum loading weight    NOTE: CERTIFICATION AND DOCUMENTATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:    On or about October 22, 2018, at 2211 Vista Parkway, Suite #8, West Palm Beach Florida, the employer failed to receive written approval from a forklift manufacturer prior to allowing the operation of a forklift that was used with a front-end elevating extension (fork-extenders) and also was not marked with alternative capacities, therefore exposing employees to struck-by and crushed-by hazards.      NOTE: CERTIFICATION AND DOCUMENTATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace:  On or about October 22, 2018, at 2211 Vista Parkway, Suite #8, West Palm Beach Florida, employees who operated Powered Industrial Trucks (Forklifts) did not receive formal instruction, practical training, and evaluation of/for a modified forklift, prior to transporting and placing palletized loads onto steel storage racks, therefore exposing employees to crush-by and struck-by hazards.  NOTE: CERTIFICATION AND DOCUMENTATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
