29 CFR 1903.19(c)(1): Within ten calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section. a. The employer has failed to submit abatement certification within ten days of the abatement date, December 17, 2018, for a violation of 29 CFR 1910.38(a), issued as citation 1, item 1, and described as follows: 29 CFR 1910.38(a): Application. An employer must have an emergency action plan whenever an OSHA standard in this part requires one. The requirements in this section apply to each such emergency action plan. a. At the workplace, the employer had not developed and implemented an emergency action plan to protect employees in the event of a fire, tornado, or other emergency. b. The employer has failed to submit abatement certification within ten days of the abatement date, December 17, 2018, for a violation of 29 CFR 1910.178(l)(1)(i), issued as citation 1, item 2, and described as follows: 29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). a. At the workplace, the employer did not ensure that each employee who was permitted to operate a forklift had completed the forklift operator training.
