29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:    (a) On or about October 24, 2018 for the employees exposed to trench cave-in hazards in an 11 foot deep trench without adequate protective systems in place, inadequate means of access and egress from the trench, and lack of head protection at the corner of Highway 83 North Bypass & 19th Avenue in Minot, North Dakota.     Note:  This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1172162, Citation 1, Item 1a, and was affirmed as a final order on 10/31/2016, with respect to a workplace located at Vicinity of 35th Street & 36th Avenue West Fargo, North Dakota.
