29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    (a)Todd O. Brueske Construction at 122 East 5th Avenue, Miller, SD 57362:  On or about and at times prior to November 7, 2018 the employer did not ensure employees were instructed in the recognition and avoidance of unsafe conditions. The employer did not effectively instruct employees in identifying conditions related  to excavation safety and hazards such as struck-by, cave-in, and crushing hazards associated with working in and around excavations.  This condition exposed an employee to struck-by, cave-in and crushing injuries.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):    (a)Todd O. Brueske Construction at 122 East 5th Avenue, Miller, SD 67362:  On or about and at times prior to November 11, 2018, the employer did not ensure employees working in an excavation were protected from cave-in hazards. Employees were installing footing forms and rebar for a new electrical building approximately 6 1/2 feet deep without an adequate protective system. This condition exposed an employee to struck by hazards associated with a trench wall collapse.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems:    a)Todd O. Brueske Construction at 122 East 5th Avenue, Miller, SD 57364:  On or about and at times prior to November 7, 2018, the employer did not ensure a competent person conducted daily inspections of the trench excavation, adjacent areas, and did not ensure an adequate protective system was utilized to protect employees entering the trench. This condition exposed employees to struck-by hazards due to cave-in and crushing hazards.
