(a)Sydell, Inc. at 46935 SD Highway 50, Burbank, SD 57010: On or about and at times prior to November 8, 2018, the employer did not ensure employees were protected from trip/fall hazards in that, the wash bay drain pit was not appropriately covered to prevent injury related to tripping or falling into the pit. This condition exposed employees to a trip/fall hazards into a pit that was approximately 3 feet deep.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): (a)Sydell, Inc. at 46935 SD Highway 50, Burbank, SD 57010: On or about and at times prior to November 8, 2018, the employer did not ensure all forklift operators were trained in operation of powered industrial trucks in that the operators were not trained in the use of Mitsubishi forklifts prior to their use. This condition exposed the employees to the hazard of improper forklift operation. Abatement Note: Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: (a)Sydell, Inc. at 46935 SD Highway 50, Burbank, SD 57010: On or about and at times prior to November 8, 2018, the employer did not ensure employees were protected from amputation hazards associated with a pinch-point regarding the Model A Kes Weld Bender. The bender's stock clamp was not guarded while clamping metal tubing before the die progressed into the tube to create a crimp or bend in the metal. The clamping action is actuated by a hand lever positioned in close proximity to the point of operation allowing the employee access to the hazard while operating the machine. This condition exposed employees an amputation hazards.

29 CFR 1910.212(a)(3)(ii): Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s): (a)Sydell, Inc. at 46935 SD Highway 50, Burbank, SD 57010: On or about and at times prior to November 8, 2018, the employer did not ensure employees were protected from amputation hazards in that, the barrier guard on the Bentenbender Model 10-1/4 was not appropriately adjusted based on the thickness of the stock being sheared. The employer did not have the guard adjusted to < or = 0.875" at the face of the guard that was less than 7.5" from the point of operation. This condition exposed employees to amputation hazards. (b)Sydell, Inc. at 46935 SD Highway 50, Burbank, SD 57010: On or about and at times prior to November 8, 2018, the employer did not ensure employees were protected from amputation hazards in that, the punch portion of the Scotchman Model 5014TH, was not appropriately guarded. Employees place their hands in close proximity to the point of operation while holding the stock in place during the punching action. This condition exposed employees to amputation hazards. (c)Sydell, Inc. at 46935 SD Highway 50, Burbank, SD 57010: On or about and at times prior to November 8, 2018, the employer did not ensure employees were protected from amputation hazards in that, the die of the Niagra HD 75-8-10 break press was not appropriately guarded. This condition exposed employees to amputation hazards.

A written hazard communication program which at least described how the criteria specified for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also included a hazardous chemicals list and methods used to inform employees of the hazards of non-routine tasks, had not been developed for employee exposures, such as but not limited, to the following, xylene, xylol, and Naptha based paint products.
