29 CFR 1910.132(a): Employer did not provide nor require the use of personal protective equipment when necessary whenever hazards capable of causing injury or impairment were encountered:    (a)Lock Trucking Company, LLC, at 1510 West Oliver Street, Spearfish, SD 57783: On or about and at times prior to November 9, 2018, the exposing employer did not ensure employees were protected from injury in that, an employee was exposed to a fall hazard while covering or pulling a tarp over a load. On November 9, 2018, an over-the-road truck driver drove his semi-truck and flatbed trailer into the tarp shed which was specifically used to tarp loads. The driver accessed the rear of a flatbed trailer and was attempting to finish strapping the lower portion of the tarp which was covering a load of wood products, when he fell off the trailer and was fatally injured. The height of the trailer measured approximately 51.5 inches from the ground. This condition exposed an employee to a fall hazard of approximately 51.5 inches.

29 CFR 1910.132(f)(1): The employer did not provide training to each employee required to use Personal Protective Equipment that covered when PPE is necessary, what PPE is necessary, how to don, doff, adjust and wear PPE, the limitations of PPE and the proper care, maintenance, useful life and disposal of the PPE:    (a)Lock Trucking Company, LLC at 1510 West Oliver Street, Spearfish, SD 57783: On or about and at times prior to November 9, 2018, the exposing employer did not provide a training program that protected employees when working four feet or more above a lower level. The employer required the use of fall protection equipment for truck drivers at certain locations, but did not ensure employees were properly trained in the use of fall protection equipment. On November 9, 2018, an over-the-road truck driver was fatally injured when he fell from the rear of a flat bed trailer while attempting to tarp his load. This condition exposed the employee to a fall hazard of approximately 51.5 inches.
