29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent:    6 Grafton Street, Millbury, MA 01527   On or about December 21, 2018,  an employee performing welding and fabricating work was exposed to noise at 77% of the action level which is equivalent to 88.1 decibels measured on the A scale over an 8-hour time weighted average (TWA).  The employer had not administered a hearing conservation program to protect employees from noise hazards.
