29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:  (a) New townhome construction located on Lot #44, Rear side: On or about 11/29/2018, and at times prior, The employer exposed an employee to collapse/fall hazards of up to 25-ft. to the lower level, in that the safety work platform used to frame the porch roof was not inserted into the sleeves provided or locked in to prevent movement during use.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  (a) New townhome construction located on Lot #44, Rear side: On or about 11/29/2018, and at times prior, The employer exposed employees to fall hazards of approximately 25-feet to the lower level, in that a personal fall arrest system was not provided to an employee engaged in framing activities on a STAR Industries Safety Work Platform which was elevated by a JLG 8042 All-Terrain Forklift Truck.

29 CFR 1926.454(a)(3): The employer did not train each employee who performs work on a scaffold, by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards, including the proper use of the scaffold and the proper handling of materials on the scaffold:  (a) New townhome construction located on Lot #44, Rear side: On or about 11/29/2018, and at times prior, the employer failed to train employees how to use the Star Industries Safety Work Platform, in that the platform was not installed or secured correctly on the forklift truck and the employee working from the platform was not provided with a fall arrest system.
