29 CFR 1926.652(c)(2)(i): Design of support systems, shield systems, or other protective systems that are drawn from manufacturer's tabulated data were not in accordance with all specifications, recommendations, and limitations issued or made by the manufacturer:    a) On December 3, 2018, the Ultra Shore "S" Series Shield that an employee used for cave-in protection while working in a trench was not constructed in accordance with the manufacturer's recommendations and limitations outlined in the tabulated data, thereby exposing the employee to cave-in and struck-by hazards:    1) The shield system contained extensive damage on the northwest panel.    2) The shield system was constructed with three spreaders, missing the lower spreader on the south end of the shield system.

29 CFR 1926.651(k)(1):  Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems:    a) On or about December 3, 2018, employer did not provide competent person training to employees working onsite in regards to excavations and protective methods.      In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
