29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    a) South side of new Food City store construction: On or about 12/06/2018, and at times prior, the employer exposed employees to fall hazards of up to nine feet, eleven inches, in that the use of personal fall arrest systems was not enforced while the employees were working on top of a refrigeration unit to install metal framing.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed:  a) South side of new Food City store construction: On or about 12/06/2018, and at times prior, the employer exposed employees to fall hazards of up to nine feet, six inches, in that the portable folding A-frame ladder being used to access the upper work area was closed and leaning against the side of the refrigeration unit while the employees were installing metal framing.
